We the undersigned, being all of the members of the Architectural Control Committee and the Board of Directors of Braeburn Valley Homeowners Association, a Texas non-profit corporation (the "Association"), a Texas non-profit corporation organized under the Texas Non-Profit Association i-\ct, do by this writing consent to the following action and adopt the following resolution:

WHEREAS, Braes Bayou Land Company was the owner of those certain tracts of land, which are as follows:

a.       Braeburn Valley, Section Three (3), a subdivision in Harris County, Texas, according to the map or plat thereof recorded in Volume 61, Page 47 of the Map Records of Harris County, Texas;

b.      Braeburn Valley, Section Four (4), a subdivision in Harris County, Texas, according to the map or plat thereof recorded in Volume 74, Page 7 of the Map Records of Harris County, Texas;

c.       Braeburn Valley, Sections Five (5) and Six (6), subdivisions in Harris County, Texas, according to the map or plat thereof recorded in Volume 92, Page 6 of the Map Records of Harris County, Texas; and

d.      Braeburn Valley, Section Seven (7), a subdivision in Harris County, Texas, according to the map or plat thereof recorded in Volume 115, Page 63 of the Map Records of Harris County, Texas

 tt(the "Subdivision"); and

WHEREAS, the Subdivision is encumbered by that certain instrument entitled "Amended Restrictions - Braeburn Valley Subdivision, Sections 3,4,5,6 and 7" filed of record in the filed of record in the Official Public Records of Real Property of Harris County, Texas under County Clerk's File No. P528083 (the "Declaration"); and

WHEREAS, the Declaration created an Architectural Control Committee ("ACC") for the purpose of protecting the aesthetic integrity of the Subdivision by prohibiting any exterior addition to or change or alteration to buildings or paved areas until the plans and specifications of the same have been submitted to and approved by the ACC as to conformity and harmony of external design, with existing structure in the Subdivision and as to location with respect to topography and finished ground elevation; and .

WHEREAS, roofs are improvements to buildings, which must receive the approval of the ACC prior to placing or installing same on a lot in the Subdivision; and

WHEREAS, Section 204.010(a)(18)(B) of the Texas Property Code provides a property owners association has the power to modify architectural guidelines as the needs of the subdivision change; and

WHEREAS, in accordance with its power to do so, the ACC desires to adopt reasonable guidelines regarding the installation of roofs, which the ACC believes is in the best interest of the Subdivision.

NOW THEREFORE, the ACC joined by the Board of Directors of the Association adopts the following guidelines for the installation of roofs in the Subdivision, hereinafter referred to as the "Guidelines", which shall be binding upon all owners and their grantees, lessees, tenants, occupants, successors, heirs, and assigns who currently or in the future may possess an interest in the Subdivision, and which shall supersede any previously adopted guidelines on the same subject matter.

I. APPLICATION PROCEDURE

All applications for the installation of roofs must be submitted to the ACC in writing by completing the application form provided by the Association. A sample of the proposed shingle to be placed on any existing roof or any new improvement must be attached to each application submitted to the ACC. The ACC has a period of forty five (45) days to approve or deny an application. This time frame must be kept in mind by the applicant when scheduling work by a roof contractor. If the applicant is experiencing a roof leak and is in need of immediate roof replacement, please inform the Association's managing agent immediately and the ACC will attempt to expedite the application process.

The ACC may maintain a chart depicting examples of the acceptable type, quality and color of roofing materials for homes and other improvements within the Subdivision. Each shingle shall be compared to the samples set forth on the roofing materials chart to assure that the proposed shingle is of an acceptable type and quality and that its color is harmonious with the color scheme established for the Subdivision.

ll. ROOFING MATERIAL

The roofing materials to be installed on any Lot or other Improvement must be approved in writing by the ACC prior to installation. The roofing material must be harmonious with the residential structure. The standard roofing material to be used in the Subdivision must be dimensional shingle of a "weathered wood" color and must have a Class "A" rating with a twenty-five (25) year or more warranty.

llI. PERMITTED ROOFING MATERIAL

The following is a list of roofing material, which may be used when considering a new roof; however, an ACC application must still be submitted for consideration and must be approved by the ACC prior to the commencement of any roof replacement.

IV. PROHIBITED ROOFING MATERIALS

 

Three (3) tab shingles and strip shingles are strictly prohibited and will not be approved by the ACC. For example, the following roof shingles will not be approved:

 

  • GAF
    • Royal Sovereign 25 year (3 tab shingle)
    • Jumbo Royal Sovereign (3 tab shingle)
    • Sentinel (3 tab shingle)

These Guidelines may be executed in multiple counterparts, which, when placed together shall constitute the fully executed original instrument.
